Hernia Patch Left on Market After Davol Knew of Health Risks

Davol, the maker of Bard Composix Kugel Hernia Mesh Patches, are used to treat hernias that usually occur where a previous incision was made in the body.

The patch has a recoil spring that is folded before insertion and after is supposed to spring open and flatten. The patches were first recalled in January of 2007 after the springs in some patches began breaking. The breaking of a spring can lead to serious and sometimes fatal injuries including bowel perforation and death.

Ignoring the fact that people began reporting injuries from the company's defect in December 2005 when an initial recall was announced, the recall did not expand until January 2007.

The FDA has accused Davol Inc. of knowingly keeping the patches on the market too long, defects and all, insisting that Davol officials understated the severity and dangerous heath complications associated with the patch.
