Woman Implanted With Recalled Hernia Patch

A Virginia Hospital system, Sentara, admitted this week that they implanted seven patients with the defective Kugel Mesh Hernia Patch after the FDA issued a Class I recall for the defective patches. The story broke when a Virginia Beach woman, Judith Coyne, called a local news station making a claim that the Sentara Virginia Beach General used the recalled product in her surgery. She complained that she was experiencing excruciating pain and that no one would believe her that the patch was the problem. On Tuesday the hospital admitted the mistake and now have confirmed that six others were also implanted with the product subsequent to the FDA's recall.

Kugel Mesh Hernia Patch Trial: Judge Expands Scope

In 2005 the FDA issued a Class I recall of certain sizes of the Kugel Mesh Hernia Patch, used to repair ventral hernias. The patches contained a memory recoil ring that allowed them to inserted into a small incision and spring back into shape, allowing for what was thought to be a better fix with a much less invasive surgical procedure. Tuesday a Federal Court judge expanded the scope of Kugel Mesh Hernia Patch litigation to include all Davol Marlex/Teflon products.

Kugel Mesh Hernia Patch: Only Time Will Tell

Almost two years ago the FDA issue a Class I recall of the Bard Composix Kugel Mesh Hernia Patch in certain sizes. The recalled patched have the potential to produce serious injury and even death due to a defect in the memory recoil ring that can lead to breakage of the ring. The broken ring can cause bowel perforation and other serious internal injuries to vital tissue and organs. The most disturbing part of this recall is that patients implanted with the defective patches are faced with a very difficult decision, remove the patch through another surgery or leave the patch in and hope for the best.

Kugel Mesh Hernia Patch: Risk of Injury Has Not Passed

The Kugel Mesh Hernia Patch was recalled almost two years ago and yet all claims may not yet be filed. Understandably many people who were implanted with the defective devices did not have patch removed if they had not experienced symptoms of failure. However, there is still a very real possibility that these patches may fail in the future causing serious and even life threatening injuries.

Hernia Patch Problems May be Yet to Occur

Just because the Kugel Mesh Hernia Patch was recalled well over a year ago doesn't mean that all of the injuries associated with the defective patches have already occured. The defective patches have memory recoil rings that could be on the brink of breakage. When the initial recall was introduced doctors had to weigh the risks of removing the patch or leaving it in and taking the chance that the ring could break causing serious injury. In many cases the risk of removing the patch outweighed the possibilty of patch failure.

Composix Hernia Patch Recall

Four Composix Kugel Mesh Patch recalls were initiated between December 2005 and January 2007, by the manufacturer, Davol Inc., due to device defects. The patch recalls were announced following numerous reports about broken recoil rings, responsible for opening the patch after being implanted in patients.

Rhode Island to be Home For Kugel Mesh Pretrial

The Kugel Mesh Hernia Patch has produced so many cases that they will now be consolidated. The Federal District Court of Rhode Island will be the site of pretrial proceedings in the hundreds of federal cases that have been filed.
The Judicial Panel on Multi-district Litigation of the United States Courts has created Master Docket No. 1:07-md-01842-ML-LDA.

Settlement Awarded In Hernia Surgery Related Death

A medical malpractice case was finally resolved earlier this week as a settlement was agreed upon by the parties involved in a case involving hernia surgery. The $750,000 settlement occurs over five years after the death of 38 year-old, Kevin Daulton.

FDA Warned Davol of Serious Violations

Davol, maker of the Bard Compoix Kugel Mesh Patch, was given a warning letter in 2006 from the FDA, citing serious problems with quality assurance systems used during the manufacturing process of creating the patch. Doctors have been advised to stop using the Kugel Mesh Patch and the FDA is recommending that patients who were implanted with Patches on the recall list seek immediate medical attention if they experience unusual symptoms.

The Kugel Mesh Patch is used to repair a ventral hernia. A hernia is described by doctors as a defect of gap in the abdominal muscle wall through which an intra-abdominal organ can protrude. Weakness or a small tear can cause this gap in the muscle. Ventral hernias usually occur in an area where surgery has previously been performed and are on the abdominal surface.

The Composix Kugel Mesh Patch is used to repair ventral (incisional) hernias caused by thinning or stretching of scar tissue that forms after surgery. The patch is placed behind the hernia defect through a small incision. The patch is then held open by a "memory recoil ring" that allows the patch to be folded for insertion and later springs open and lays flat once it is in place. The FDA issued a Class 1 Recall of certain lot numbers of the Composix Kugel Mesh Patch because the "memory recoil ring" that opens the Composix Kugel Mesh Patch can break under the stress of placement of the large sized products in the intra-abdominal space. This can lead to bowel perforations and/or chronic intestinal fistulae. The FDA notice contains all of the product codes and lot numbers affected by the recall.

History of Hernia Patch Raises Concerns about Recall

An article in the New York Times challenges the behavior of Davol, a division of C.R. Bard, after they were informed of defects in its Kugel Hernia Mesh Patch. The FDA has received reports of over 80 injuries and other problems relating to the patch, some including fatalities.

In 2005, Bard recalled specific versions of the mesh patch due to risk of a plastic component breaking and cutting through a patient's internal organs. The article says "Bard executives were fully aware of serious injuries and risks associated with the device."
