The Kugel Mesh Hernia Patch was recalled almost two years ago and yet all claims may not yet be filed. Understandably many people who were implanted with the defective devices did not have patch removed if they had not experienced symptoms of failure. However, there is still a very real possibility that these patches may fail in the future causing serious and even life threatening injuries.
The Kugel Mesh Hernia Patch was designed to spare its recipients from the pain and suffering that can be commonly associated with hernia surgery. Hernias have a very good chance of recurring in previously repaired areas, as the tissue is weaker near areas that have been previously repaired. The Kugel Mesh Patch was designed to better support these areas providing greater protection from reoccurring hernias. The design of the patch was thought to be truly revolutionary and received much praise during the early going, however; by 2005 it was clear that something had gone terribly wrong.
The memory recoil ring that allowed the patch to expand and lay flat once inserted into the affected area was defective. Sadly this ring was predisposed to breakage and caused many people serious injuries and some it even cost their lives. In response to the abundance of injuries associated with the patches the FDA issued a Class I recall of the defective devices.
For those implanted with devices that have not yet failed are at risk of future failure and injury resulting from this failure. The innocent victims of these failed devices deserve justice and the manufacturer, Davol, must be held accountable for their unsafe practices that resulted in thousands being injured and many more at risk of injury from their defective medical devices.
