In 2005 the FDA issued a Class I recall of certain sizes of the Kugel Mesh Hernia Patch, used to repair ventral hernias. The patches contained a memory recoil ring that allowed them to inserted into a small incision and spring back into shape, allowing for what was thought to be a better fix with a much less invasive surgical procedure. Tuesday a Federal Court judge expanded the scope of Kugel Mesh Hernia Patch litigation to include all Davol Marlex/Teflon products.
Before Tuesday's decision the current litigation only covered products with "memory recoil rings." This decision will now cover products both with and without "memory recoil rings". Pretrial proceedings have been consolidated to Rhode Island, the home of manufacturer Davol. This is a big win for plaintiffs' attorneys with clients who claim to have been injured by patches without recoil rings.
