The Kugel Mesh Hernia Patch has produced so many cases that they will now be consolidated. The Federal District Court of Rhode Island will be the site of pretrial proceedings in the hundreds of federal cases that have been filed.
The Judicial Panel on Multi-district Litigation of the United States Courts has created Master Docket No. 1:07-md-01842-ML-LDA.

The Kugel Mesh Hernia Patch was recalled due to a malfunction of the memory recoil ring that allowed the patch to spring open once it was placed into the body through a small incision. This ring has been shown to break and cause bowel perforations and other serious health concerns.

"Davol, the manufacturer of this recalled hernia patch, has marketed a product that the FDA considers as 'probable to cause serious adverse health consequences and death' and 'did not accurately report the severity of complaints' about the device to the FDA according to the New York Times."

Things do seem to be moving along with this litigation and maker, Davol and its parent company D.R. Bard undoubtedly have some stressful months coming up in the future.
