Kugel Mesh Patch Lawsuits Still Being Filed

Over two years after the FDA issued a Class I recall of certain Kugel Mesh Hernia Patches new lawsuits are still being filed. As recently as last week an Arkansas man, Marion Teague, filed a product liability lawsuit against C.R. Bard and Davol Inc. on December 28 alleging that a defective Kugel Mesh patch caused his injury. Teague claims that after several surgeries to repair hernias he began to experience intense abdominal pain and inflammation. Teague says this was due to an infection caused by a defective patch. Teague required an additional surgery to have the patch removed. He is now seeking compensation for his injuries.

Kugel Mesh Lawsuits Move Closer To Trial

The FDA recall of Kugel Mesh Hernia Patch is almost two years old now and the lawsuits that have been filed on behalf of those injured are moving closer and closer to trial. There are reports that new injuries are still being reported to the FDA's adverse event reporting system. Rhode Island has been selected as the headquarters for all pretrial proceedings, with over 100 cases being consolidated to the Rhode Island Federal District Court. This is the first time that Rhode Island has been selected as consolidation site by the Judicial Panel on Multidistrict Litigation and was the best option as the Davol; the makers of the defective patch are also headquartered in Rhode Island.
Kugel Mesh Cases Will be No Problem for RI Courts

For the first time in history Rhode Island has been named the site of multidistrict litigation. This means that all of the cases filed all over the country involving Davol's Kugel Mesh Hernia Patch have been transferred to the Rhode Island District Court for pretrial proceedings and a possible settlement. Over 150 cases in all have consolidated to the Rhode Island courts and Judge Mary Lisi, who will be presiding over pretrial matters in federal cases, said that there should be no problems with trying the cases in Rhode Island.

Numerous Lawsuits Filed In Hernia Patch Recall

The recent recalls of the Kugel Mesh Hernia Patch has resulted in numerous lawsuits being filed against Davol, the maker of the recalled patches. In 2005 the first recall was made for the defective patches, but this has been recently expanded to include other sizes and shapes of patches. Basically a hernia is protrusion of internal organs or tissue through a weak area in the abdominal wall, during surgery the man made mesh material was placed inside the hernia, which allows for extra support of the abdominal wall.

Estate Sues For Defective Kugel Mesh Patch

In May of this year the estate of an Ohio man filed a lawsuit alleging that the 68 year-old died due to complications from a defective Kugel Mesh Hernia Patch. Richard Kinney had hernia surgery in October of 2003 and only a few short months later he met his demise. The lawsuit claims that the hernia repair surgery directly lead to his death on March 9, 2004.

Estate Sues in Death After Hernia Operation

In October 2003, Richard, had surgery to repair a hernia. Four months after the surgery the 68-year-old man died. The hernia lawsuit contends his death was the result of a defective patch.
On Tuesday, Richard's estate filed a lawsuit in the U.S. District Court in Akron against Davol Inc, the patch manufacturer, known as the Composix Kugel Mesh Patch. Also named in the lawsuit is Davol's parent company, C.R. Bard Inc.

Lawsuit against hernia mesh patch maker

A press release in December 2006 reported that a Composix Kugel Hernia Mesh Patch patient was suing medical product manufacturer Davol, Inc. of Rhode Island because of severe bowel problems and other issues associated with the defective medical product.
