Defective Hernia Patch Lawsuit

A woman is suing Davol Inc., saying a defective hernia patch is the cause of her needing several expensive surgeries.

The Kugel Hernia Patch made by Davol Inc. and its parent company C.R. Bard, Inc. did not repair her abdominal hernia as intended when she was implanted with the patch in July 2005. The product malfunctioned, causing nerve damage and required further surgery to have the patch removed, states the lawsuit.

The lawsuit, filed in Greene County Circuit Court seeks fair and reasonable damages.

The defendants deny the claims and have filed a request to have the case moved to the U.S. District Court.

In December 2005, C.R. Bard issued a recall of the hernia patch.
