A Missouri woman, who claims a defective hernia patch injured her creating the need for several expensive follow up surgeries, has filed a lawsuit.
The suit alleges the hernia patch, made by Davol Inc. and its parent company C.R. Bard Inc., failed to properly repair her abdominal hernia as intended during hernia repair surgery in July 2005. The hernia patch malfunctioned causing nerve damaged that required more surgery to remove the implanted patch.
The lawsuit, filed in Greene County Circuit Court seeks "fair and reasonable" damages. The company denies the claim and has filed a request to move the case to U.S. District Court.
In December 2005, C.R. Bard issued a recall of the hernia patch.
